All of the icons are copyrighted by Apple because the whole system is copyrighted by Apple.

Unless there is an API that makes the icon accessible them you are breaking Apple's copyright.  If there is an icon you want to use, send an email to DTS asking for an API.

That said, it may not be worth Apple's effort to make you stop using it.
